Server Arts is committed to maintaining a responsible and lawful presence on the Internet at all times. In an effort to achieve this goal, Server Arts maintains an acceptable use policy (AUP) which must be adhered to by all Server Arts customers at all times. The following constitute unacceptable use: 

Illegality in any form, including but not limited to activities such as unauthorized distribution or copying of copyrighted software, violation of U.S. export restrictions, harassment, fraud, trafficking in obscene material, drug dealing, and any other illegal activities.
Net abuse, including but not limited to activities such as using a non-existent email return address on a commercial solicitation, spamming (sending unsolicited advertising to numerous email addresses or newsgroups and/or generating a significantly higher volume of outgoing email than a normal user), allowing spamming by third parties to promote a web site hosted by Server Arts, trolling (posting outrageous messages to generate numerous responses), mail-bombing (sending multiple messages without significant new content to the same user), subscribing someone else to a mailing list without that person's permission, cross-posting articles to an excessive number of newsgroups, or attempting without authorization to enter into a secured computer system. Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.  Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses. Pinging, flooding, mail-bombing, or denial of service attacks. Activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service, or equipment. Facilitating the violation of this (AUP)  in any way, shape or form including but not limited to facilitation of the means to spam, initiation of pinging, flooding, mail-bombing, denial of service attacks, and piracy of software. Accessing illegally or without authorization computers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking"). Also, any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity).  Server Arts reserves the right to determine what constitutes net abuse.
Tortious conduct, including but not limited to posting of defamatory, harassing, abusive, threatening, scandalous, or private information about a person without their consent, intentionally inflicting emotional distress, or violating trademarks, copyrights, or other intellectual property rights, advertising, transmitting, or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards, and pirating software, Engaging in activities, whether lawful or unlawful, that Server Arts determines to be harmful to its customers, operations or reputation. Server Arts reserves the right to determine what constitutes tortious conduct.
Abuse of Server Arts shared system resources, including but not limited to employing posts or programs which consume excessive CPU time or storage space; permitting use of mail services, mail forwarding capabilities, POP accounts, or auto-responders other than for the customer's own account, reselling shared services made available by Server Arts as a part of a hybrid hosting package without prior and explicit permission, utilizing shared services made available by Server Arts as a part of a hybrid hosting package in any way that interferes with optimal operation of these resources and the use of these resources by other Server Arts customers sharing them.

In addition, please observe the following policies:

IP Usage. Due to ARIN restrictions, justification regarding the efficient use of IP addresses may be required. Manipulation of the IP addresses installed on any dedicated server offered as part of hybrid hosting packages by any party other than an authorized Server Arts representative is strictly prohibited and will result in immediate cancellation of services.
Security Providers, such as any Server Arts customers wishing to use Server Arts’ services in order to perform security-related business tasks that may constitute unacceptable use according to this (AUP) must obtain prior and explicit permission by Server Arts to do so, otherwise they will be subject to the consequences of violating this (AUP).
Service Providers (xSPs)
, such as subscribers who offer Internet services are not excluded by any clauses in this
(AUP)  and must fully cooperate with Server Arts in any corrective or preventive action that Server Arts deems necessary to rectify a violation of this (AUP). Failure to cooperate with such corrective or preventive measures is a violation of Server Arts (AUP)  and may result into cancellation of services without prior notice. 
Bandwidth Utilization. Each hybrid hosting plan allows for a specific amount of monthly transfer. For bandwidth utilization purposes calendar months are used to calculate transfer. Bandwidth utilization is dynamically and continuously measured and allowed transfer rate may be adjusted on a per server basis, based on daily utilization values and total monthly allotment. Servers exceeding their allotted rate may be subjected to bandwidth metering unless a higher transfer rate is purchased. It's the customer's responsibility to choose the level of transfer rate desirable.
